Thanks for using Form Factory (“Form Factory”, “we”, “our”, or “us”). These Terms govern your access to and use of our service, websites, and related apps (collectively, the “Service”). By using the Service, you agree to these Terms.

1) Your account & workspace

• You must provide accurate information and keep your account secure.
• Workspace owners/admins manage members and permissions.

2) Forms, files, and responses

• You (or your org) own the content you create and responses you collect.
• You’re responsible for lawful collection and use of personal data.

3) Acceptable use

• No illegal, harmful, deceptive, or infringing activity.
• No malware, spam, scraping, or bypassing security.

4) Privacy

Our Privacy Policy explains how we handle data.

5) Email & third-party services

• We may send transactional messages (verification, resets, notices).
• We rely on third-party providers (e.g., hosting, email, auth).

6) Service availability & changes

• We aim for high availability but do not guarantee uninterrupted operation.
• We may update or discontinue features; material changes will be noticed when feasible.

7) Third-party infrastructure & data loss

We use reputable third-party providers to host and operate the Service. While we take reasonable measures to protect your data, we are not responsible for data loss, corruption, downtime, or other issues caused by third-party providers or the public internet. You are encouraged to export and back up your important data regularly.

8) Beta features & data retention

From time to time, we may offer beta, preview, or experimental features (“Beta Features”). Beta Features are provided “as is,” may change or end at any time, and data stored in beta is retained only for the duration of the beta. When a beta ends, associated data may be deleted and may not be recoverable. Please export anything you wish to keep.

9) Fees (if applicable)

• Some features may require payment; details are shown at checkout or in your plan.

10) Intellectual property

• We retain all rights in the Service; you get a limited license to use it.

11) Termination

• You may stop using the Service at any time. We may suspend/terminate for violations.

12) Disclaimers & limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY WILL NOT EXCEED AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13) Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Courts in Ontario, Canada have exclusive jurisdiction.
